Smoking Ban
The Welsh Assembly Government has sent all businesses in Denbighshire information about what they need to do to comply with the regulations.
The legislation creates three specific offences therefore the owners of businesses will be breaking the law if they:-
1 Fail to display no smoking signs in premises covered by the law
2 Smoke in a smoke free place
3 Fail to prevent smoking in a smoke free place
If you break the law?
Individuals may be fined a fixed penalty of £50 for smoking in smoke free premises. For a summary conviction, the maximum fine will be up to £200.
The manager or person in control of any smoke free premises could be fined a fixed penalty of £200 for failing to display warning notices or for allowing others to smoke on the premises. For a summary conviction, the maximum fine will be up to £1000.
The offence of obstruction of an officer authorised by the local authority to enforce the legislation carries a maximum fine of £1,000.
Who will enforce the law?
Authorised officers of the Local Authority will enforce the law. They will have the powers to enter premises to establish that the smoke-free legislation is being complied with.
