Disability Equality

The Disability Discrimination Act 1995 was established to make it unlawful to discriminate against disabled persons in connection with employment, the provision of goods, facilities and services or the disposal or management of premises; to make provision about the employment of disabled persons; and to establish a National Disability Council.

The Disability Discrimination Act 2005 places a duty on a wide range of public bodies, including local authorities, to promote disability equality (the general duty). It also creates a specific duty to produce and publish a Disability Equality Scheme. Denbighshire County Council has a specific duty to produce a Disability Equality Scheme as expressed by the Disability Equality Duty. The Scheme has been integrated into Denbighshire’s Equality Scheme 2007 – 2009 which was agreed at full Council in July 2007. It will be reported on annually and reviewed and revised every 3 years. This means that the Council, in carrying out its functions must have due regard to the need to:

  • Promote equality of opportunity between disabled persons and other persons;
  • Eliminate discrimination that is unlawful under the Act;
  • Eliminate harassment of disabled persons that is related to their disability;
  • Promote positive attitudes towards disabled persons;
  • Encourage participation by disabled persons in public life;
  • Take steps to take account of disabled person’s disability even where that involves treating disabled persons more favourably than others.
