Contaminated Land

The Environment Act 1995 introduced the requirement for Local Authorities to take a lead role in the identification and assessment of contaminated land within their area.   Land which can be considered to be contaminated under these provisions is any land within our Authority which can be shown to either cause significant harm, or create a serious risk of harm due to substances in, on, or under that land.

There are means available for us to require any land identified in this process to be remediated by the person responsible for the contamination, or the land owner.

Where the risk involves the potential for pollution of controlled waters, or the site is a ‘special site’, the responsibility for investigation, assessment, or remediation enforcement, will be on the Environment Agency.
