THE ACT
BACKGROUND
The Freedom of Information Act 2000 became law on the 30th November 2000 and will be brought fully into force on 1st Januray 2005. It gives a general right of public access to all types of 'recorded' information held by public authorities, which includes Denbighshire County Council.

PURPOSE
The purpose of the Act is to develop a culture of openness and accountability within public authorities by providing easy access to information relating to business processes and decisions. The aim is to make information available
and more accessible to all through a publication scheme where individuals can then find out the relevant information for themselves.
PUBLICATION SCHEME
As a public authority, the Council is required to adopt and maintain a publication scheme, which must be approved by the Information Commissioner. Such schemes set out:
- the classes of information we publish
- the manner in which it is published
- details of any charges
PUBLIC INTEREST
Some information is exempt from disclosure by the Act so does not have to be provided. However, even if an exemption does apply the Council must still consider whether there is an overriding public ineterest in disclosing the information. The balance will always wherever possible lie in favour of disclosure.
THE INFORMATION COMMISSIONER
