Civil Parking Enforcement

INTRODUCTION

Parking enforcement is undertaken to keep roads safe and traffic flowing and to safeguard the interests of residents, including Blue Badge holders. A regular turnaround of parking spaces will encourage visitors, and ensure that traders and residents can go about their business conveniently and without frustrating delays caused by illegal parking.

With effect from 31 March 2008 Denbighshire County Council is operating new parking regulations called Civil Parking Enforcement. These will make parking enforcement fairer and more transparent, ensuring that motorists are provided with a much improved and consistent service.

LEGISLATION

Civil Parking Enforcement is part of the Traffic Management Act(2004), which is aimed at keeping traffic moving. It includes higher penalty charges for more serious contraventions, such as parking on a double yellow line, and lower charges for other contraventions, such as overstaying on a meter.

Wales Penalty Processing Partnership (Denbighshire, Gwynedd, Wrexham & Anglesey) have been working closely to ensure consistency and high standards.

WHAT DOES THIS ALL MEAN

Parking Attendants will be referred to as Civil Enforcement Officers.

  • There will be two levels of Penalty Charges depending on the seriousness of the contravention, and a full list of which are set out in attached Parking Penalties page.
  • The higher penalty will be £70 (reduced to £35 if paid within 14 days).
  • The lower penalty will be £50 (reduced to £25 if paid within 14 days).
  • In some circumstances it will no longer be necessary for a Penalty Charge Notice to be placed on a vehicle, or handed to a driver in order for it to be properly served. If for whatever reason a Civil Enforcement Officer is unable to serve the Notice at the time it may be posted to the registered keeper/ owner of the vehicle.
  • If a vehicle is driven away before the Notice is issued, it may be posted to the registered keeper of the vehicle.
  • Independent adjudicators appointed on behalf of the Government will have increased powers to refer appeals on Penalty Charge Notices back when they consider that the Council should have used its discretion to cancel the Penalty Charge earlier.

HOW CAN I AVOID GETTING A PENALTY CHARGE NOTICE?

  • Do not park on double yellow lines unless you are loading / unloading or picking up / dropping off passengers. Civil Enforcement Officers will observe a vehicle to ensure that loading or unloading is evident.
  • Do not park on single yellow lines during restricted hours unless you are loading / unloading or picking up / dropping off passengers. There should be a sign nearby which tells you when the restriction is in force.
  • Park wholly within a marked bay. Taking up more than one bay is frustrating for other drivers trying to find a space.
  • Keep some loose change in your car to purchase a pay and display ticket. Don’t risk going for change and leaving your car in a pay and display area without displaying a valid ticket.
  • Do not park in bays designated for other users such as disabled bays, bus stops and taxi ranks.
  • If you’re a Blue Badge holder, please ensure that your badge is displayed so that the expiry date can easily be seen (i.e. photograph down), and set the clock at your arrival time. Disabled drivers should also not park in areas designated for other users.
