Denbighshire County Council Licensing team will not tolerate landlords who ignore the ban on smoking in an area designated as smoke free.
Susan Murphy, the landlord of the Liverpool Arms, Wellington Road, Rhyl was found guilty of allowing people to smoke in her establishment on March 14, 2008.
Officers from Denbighshire’s Licensing department found ashtrays on the tables and the room smelled of tobacco smoke. Cigarette stubs and part smoked cigarettes were scattered on the floor.
Ms Murphy, the defendant, stated she was having a private party, however, the bar room satisfies the requirement of being a designated smoke free area. Although there were notices advising customers that it was an offence to smoke on the premises, the defendant had allowed people to smoke there that night.
She was fined £100 and ordered to pay £50 prosecution costs.
