Terms and conditions of the grant

  1. The general public must have a right to use the toilets without restriction during the agreed opening hours.
  2. Denbighshire County Council will advertise the toilets on its website and in other publications that are available to the public without restriction.
  3. Denbighshire County Council officers have the right to carry out monitoring inspections of the toilets at any reasonable time.
  4. The Establishment must have a regular arrangement for the toilets to be clean and hygienic throughout the day, and there must be toilet rolls, soap, bins and hand drying facilities. The Establishment must ensure that at no time does the condition of the toilets become unsuitable or create a risk to the users.
  5. Denbighshire County Council will evaluate grant applications and set the level of the grant payment to the Establishment based on the circumstances of the Establishment and its toilets, namely:
    • the daily opening hours (minimum of 20 hours per week)
    • the days when it is open
    • the operating period of the Establishment (seasonal or all-year)
    • the range of facilities available for the public’s use
    • the condition and quality of the facilities, and
    • a current and suitable public liability insurance policy for the Establishment.

  6. Denbighshire County Council will determine the grant amount that the Service Provider may receive when it evaluates the application. The grant money will be released in arrears in one payment at the end of the financial year (end of March). Applications made part way through the year will be paid pro-rata in arrears. The maximum grant amount payable is £500 per year. All Applications will be assessed on need.
  7. The Service Provider may terminate the agreement by giving one month’s written notice to Denbighshire County Council, at publictoilets@denbighshire.gov.uk. Payment will be made at the end of the financial year (end of March) for the period in which the toilets were available pro-rata in arrears until the date of termination.
  8. Denbighshire County Council may terminate the agreement because of financial circumstances or exceptional reasons by giving one month’s notice to the Service Provider. In the event that Denbighshire County Council considers that the Service Provider is in breach of the agreement then the agreement will terminate immediately upon notification to the Service Provider by email to the address provided on the application form, that the agreement is terminated. Payment will be made at the end of the financial year (end of March) for the period in which the toilets were available pro-rata in arrears until the date of termination.
  9. The agreement between Denbighshire County Council and the Service Provider for each Establishment will be a rolling contract that will automatically renew unless one of the parties terminates the agreement in accordance with the provisions contained in these terms and conditions.
