Street trading: Pubs, food vans and pop-up food traders

Street trading consent may be required for selling food and drink from pub car parks, food vans, pop-up food sites and other privately owned land that the public can access. 

Consent may be needed where:

• pubs and venues host traders on their land
• food is sold from vans, trailers or temporary stalls
• street food traders operate from land open to the public
• events have food or drink stalls 

When street trading consent is needed

Street trading consent is usually required when selling takes place in:

• street and public areas
• pub car parks and forecourts
• supermarket and retail park car parks
• privately owned land that the public can access

Late Night Refreshment

To legally sell hot food or hot drink between 11pm and 5am, one of the following must be in place as well as street trading consent:

• a Temporary Event Notice (TEN) for short-term or one-off events lasting no more than seven days
• a Premises Licence for regular, long-term, or permanent late-night trading

This requirement applies to all street traders, including mobile vans and stalls, if the food or drink is heated on the premises or sold hot to be eaten elsewhere. Cold food and non-alcoholic cold drinks do not require these additional licences.

Fines and penalties

Enforcement action can be taken if someone:

• trades without street trading consent or the required licence
• trades on a street where trading is prohibited
• doesn’t keep to the conditions of their street trading consent

Enforcement action can include:

• street trading consent or the required licence being suspended or withdrawn
• fines of up to £1,000
