Trading at markets and events 

When trading at markets or events in Denbighshire, consent may be needed depending on the type of goods being sold and the location. 

Markets with five or more stalls

If an event has five or more stalls, the trading activity would be classed as a market and will not require street trading consent. The organiser would need to make sure that they have any other relevant permissions.

Events with four or less stalls

If an event has four or less stalls, each stall holder would need to apply for street trading consent.

Alcohol sales, late night refreshments and entertainment

For any event or market offering alcohol sales, late night refreshments or regulated entertainment (such as live or recorded music), the organiser will need to apply for either a Temporary Events Notice or a Premises Licence.

A licence is not needed for entertainment which is not the main reason people are attending (e.g. background music). 

Temporary Event Notices (TENs)

A Temporary Event Notice (TEN) is needed for an event that involves selling alcohol, offering late night refreshments (selling hot food or hot drink between 11pm and 5am) or offering entertainment on a temporary basis. It applies to short-term events and must be arranged in advance.

Premises licence

A premises licence is required when alcohol is sold at an event on multiple days or as part of a series of events.

Landowner permission

Permission from the landowner is needed to use the event space, whether it is on private or public land.

Fines and penalties

Enforcement action can be taken if someone:

• trades without street trading consent or the required licence
• trades on a street where trading is prohibited
• doesn’t keep to the conditions of their street trading consent

Enforcement action can include:

• street trading consent or the required licence being suspended or withdrawn
• fines of up to £1,000
